Residential Premises - We are able to assist Landlords and Tenants in relation to problems arising with residential tenancies, informing them of their rights and obligations under the Residential Tenancy Act. Where required, we are able to represent clients at ACAT (the new super tribunal which now deals with Residential tenancy matters).
Commercial Premises - Routinely, we assist both Landlords and Tenants with the leasing of commercial premises.
When acting for Landlords, we ensure that the requisite Disclosure Statement and Lease comply with the Leases (Commercial & Retail) Act 2001 and reflect the agreement reached with the Tenant. Many commercial leasing matters also involve separate Car Park Agreements and we are able to prepare this documentation also. Following execution of the Lease by all parties, we attend to registration of it.
When acting for Tenants, we advise the Tenant of their obligations under the proposed Lease as well as matters contained in the proposed Lease to which they might wish to have changes negotiated. We assist with negotiation of those amendments and assist our clients with execution of the documents. We also follow up to ensure that the Lease has been registered by the Landlord's solicitors, ensuring our Tenant clients' rights are fully protected.
In addition to acting in relation to new leases, we also act on matters involving the assignment of existing leases. Frequently, such assignments go hand in hand with the sale or purchase of a business, with which we are also able to assist.
