Vacant Land/ Contemporaneous Building Contracts/or 'Traditional' House and Land Packages
Building Contracts - There is an emerging trend
among Builders to change the traditional House and Land Package process.
Increasingly, this is now done as a Land purchase (either from the
Builder or the Land Development Agency) with a separate Building
Contract between the Builder and the Buyer. The Builder requires the
Buyer to enter into both Contracts simultaneously.
Both Contracts are usually lengthy, complex and involve numerous
potential traps for the Buyer which may see them liable for additional
unbudgeted and unanticipated building costs. However, so long as all
the legal issues are properly covered, they can be a very affordable way
to enter into the property market.
Unit Plan Purchases -
KJB Law acts on behalf of Clients purchasing into established
Units Plans, ensuring that Clients are aware of the importance of
inspecting the Body Corporate Registrar and what to look for on
undertaking such an inspection, while we cover the legal side of the
Conveyancing transaction.
Small Units Plans -
If buying into a small units plan (eg what is sometimes [albeit
incorrectly] called a dual occupancy), we are also able to provide an
explanation of what the Buyer needs to do to run their body corporate,
sample minutes for their meetings and a simple units plan register for
them to maintain. We do not charge for this separately. To our
knowledge, we are the only firm that provide Buyers with this practical
assistance when they are purchasing into a small units plan.
Off the Plan Unit Purchases -
Due to changes in the Unit Titles Act, there are substantial
disclosure requirements upon developers when a sale of a unit is being
made “off the plan”. These disclosure requirements provide greater
certainty for Buyers as to the type of unit development into which they
will be purchasing. Unfortunately, it also results in extremely large

aware, as well as advising our clients on those matters in relation to
which changes should be sought to provide adequate protection for the
Unit Plan Buyer.
