Buying and Selling Residential Houses

Conveyancing is the term used to describe the legal process of transferring the title in the property from the seller to the buyer. KJB Law provides conveyancing services in the ACT and NSW.

For the Seller – When acting for a Seller, we ensure that the Contract for Sale is prepared in accordance with either the NSW OR ACT Legislative requirements and that all necessary documentation is included in the Contract prior to the marketing of the property. Our process is designed to draw out any issues (legal or otherwise) which may be cause for concern and bring them to your attention so that appropriate steps can be taken prior to your full commitment to the Sale. We carry through the process to exchange of contracts, discharge of mortgages and final settlement of the matter.

For the Buyer - we fully review the Contract for Sale to make sure that the Seller’s title is legal; that the property accords with your understanding of what you propose to purchase and that there are no hindrances on the title or the property that may be detrimental for you. We ensure that the Buyer obtains a good and marketable title together with all the rights that you need to own and occupy the property. We carry through the process to exchange of contracts, advice re mortgage documentation and final settlement of the matter.

Our Service includes:

  • a face to face meeting, to go through the Contract
  • extensive notes which confirm our advice regarding the standard terms of the Contract
  • one page checklist to assist Client in keeping track of matters requiring attention;
  • telephone and/or email contact to keep the Client up to-date
  • letters to the Client when major events occur during the process - eg exchange of contracts;
  • we liaise with the Seller or Buyer’s representative, any discharging or incoming mortgagee and/or mortgage brokers to ensure that Settlement dates are kept to correct time schedules
  • we keep the Real Estate Agent in the loop regarding any negotiations for amendment;
  • Clients receive a copy of the Settlement Statement prior to settlement to confirm the conveyance amount;
  • We assist Clients eligible for Home Buyer Concessions with their application forms as well as any First Home Owner Grant application (if not already being processed through a client's financial institution)
  • Clients receive a hard copy of the initial Contract for their information and the original Contract is provided on completion of the conveyance for their records.
