People who have been a victim of domestic violence (including harassing and offensive behaviour) and who fear that they will be subjected to further violence can apply for a Domestic Violence Order which will restrain the perpetrator from approaching them or going to certain places where the victim is likely to be (such as their home and workplace). If the Respondent to a domestic violence order breaches the Order they may be arrested.
Where urgent protection is required the Court has the power to make interim protection orders on the same day that an application is filed. In some circumstances police officers will apply for an emergency order on a victim's behalf. The Legal Aid Office has a Domestic Violence Unit at the Magistrates Court where duty solicitors can assist you to apply for an interim order. Because of the urgency of these applications Legal Aid does not require proof of financial eligibility for Legal Aid before they will provide this initial representation.
If you have been served with an interim protection order it is very important that you comply with the terms of the Order as the penalties for breach of the Order can be quite severe.
